These Terms and Conditions ("Terms") govern use of the IraqMoto website, iOS application and Android application (collectively, the "Services"). By creating an account, publishing content, messaging another user, or otherwise using a non-public feature, a user agrees to these Terms, the Privacy Policy and the Community Guidelines.
If a user does not agree, the user must not create an account or use non-public features. Mandatory rights under applicable law are not excluded by these Terms.
IraqMoto provides an online marketplace that helps users discover, advertise and discuss motorcycles. IraqMoto is not a motorcycle dealer, broker, mechanic, inspector, delivery provider, title service, payment intermediary or escrow provider and is not a party to a transaction between users.
IraqMoto does not inspect or guarantee any motorcycle, seller, buyer, dealership, price, description, document, registration status, ownership, legal status, safety, condition, mileage, history or availability. Users are solely responsible for inspection, identity and ownership checks, legal-document verification, price negotiation, payment, registration transfer, taxes, delivery and compliance with applicable law.
IraqMoto does not hold motorcycle purchase money and does not provide refunds for motorcycle purchases.
People under 18 may browse public content but may not create an account, publish a listing, message a seller or participate in a marketplace transaction. By creating an account, a user represents that the user is at least 18 and legally capable of agreeing to these Terms.
Users must provide accurate information, maintain a single legitimate identity unless IraqMoto authorizes business accounts, protect passwords and one-time codes, and promptly notify IraqMoto of suspected compromise. Users may not transfer, sell, rent or share accounts or impersonate another person or organization.
IraqMoto may require email or security-code verification and may restrict access when account integrity cannot reasonably be confirmed. Users are responsible for activity performed through their accounts unless caused by IraqMoto's failure to use reasonable security measures.
A listing must:
New listings and material edits may remain pending until reviewed. Review does not constitute inspection, authentication, endorsement or a guarantee. IraqMoto may reject, hide, edit the presentation of, expire or remove a listing that violates these Terms or creates a safety, fraud, legal or quality risk.

Users must communicate respectfully and use messages only for legitimate marketplace purposes. Harassment, threats, discriminatory abuse, sexual content, spam and fraud are prohibited.
Ratings and reviews must reflect a genuine interaction and may not be purchased, exchanged or manipulated. Users may report advertisements, users and individual messages through the reporting controls in the Services, or by emailing [email protected]. Users may also block another account; blocking is enforced by IraqMoto's servers and prevents further messages between the two accounts. A blocked-account list is available in account settings, and blocking may be reversed there at any time.
Urgent safety reports are normally reviewed within 24 hours. This is a review target, not a guarantee of final resolution within 24 hours. IraqMoto may request evidence, preserve relevant records, refer a matter to competent authorities, restrict accounts or content, and inform affected users where appropriate.
Before paying or transferring a motorcycle, users should meet in a safe public place, verify identity and ownership, inspect the motorcycle through a qualified independent person, validate all documents with competent authorities, use lawful and traceable payment methods, and complete registration or ownership transfer properly.
Users must not rely on a listing's publication, prominence, badge or review status as a substitute for independent checks. Users should not send advance money to an unverified person.
Core selling remains available without charge: users may publish, edit and manage listings; call, use WhatsApp and share; view favorites and basic listing statistics; and use a normal seller profile. Free listings remain eligible for ordinary organic visibility. IraqMoto does not guarantee a particular rank, number of views, enquiry or sale for either free or promoted content.
The Services display the following optional products in Iraqi dinars: Featured placement at 3,000 IQD for 7 days or 5,000 IQD for 14 days; IraqMoto+ at 10,000 IQD for 30 days; showroom Basic at 75,000 IQD for 90 days; showroom Pro at 150,000 IQD for 90 days; and showroom Elite at 200,000 IQD for 90 days. Separately, as an introductory dealership offer, one eligible showroom may receive its first 90 days (three months) of Pro for 0 IQD.
The free Pro period may activate only once for each normalized dealership telephone number. It starts only after IraqMoto approves the showroom and its first motorcycle is published. IraqMoto stores a one-way fingerprint of that number as eligibility evidence; changing or recreating the owner account, showroom name, slug or showroom record does not reset the offer. The offer does not renew automatically and does not convert into a paid order. When it expires, the showroom and existing inventory remain, but Pro benefits end. The regular Pro catalogue price is displayed for future launch, but no renewal or payment can be completed while electronic payments remain disabled.
After a motorcycle listing has already been submitted without charge, the Services may offer the seller a Featured option. The seller may decline or close that offer and continue with the ordinary free listing. Declining does not cancel the submission, impose a charge or reduce the listing's ordinary organic eligibility. Featured placement may add a badge, stronger default-search ranking and an opportunity for homepage exposure, but does not guarantee approval, views, button clicks, timing or a sale.
IraqMoto+ is an account-level 30-day entitlement, not a charge for an individual listing. An active entitlement includes one 14-day Featured allowance and two 7-day Featured allowances—11,000 IQD of displayed Featured value per benefit period—plus four listing refreshes, an IraqMoto+ badge and premium profile customization. Basic 7/30-day listing performance remains available without charge; a paid plan may later add deeper history or comparisons only where the Services explicitly display them. A refresh moves the listing upward among ordinary listings; it does not make that listing Featured. Buyer benefits include faster saved-search alerts with a quiet period beginning at one hour, listing price history and an asking-price comparison based on the median of sufficiently similar active listings. Alert timing remains subject to matching inventory, notification permission and service availability. Price history and asking-price comparisons are informational, are not an appraisal or mechanical inspection, and do not guarantee value, condition or a fair transaction.
Showroom Basic permits up to 20 published active motorcycles. Pro permits up to 60, up to three staff accounts, advanced analytics, bulk inventory management and two 7-day Featured credits in each 30-day benefit period. Elite permits up to 200, up to five staff accounts, the strongest showroom-directory visibility, advanced bulk tools, four 7-day and one 14-day Featured credits in each 30-day benefit period. Only published active motorcycles count toward these limits. Advanced showroom reports count recorded views, WhatsApp-button clicks, call-button clicks, listings marked sold and best-performing motorcycles; button clicks do not prove that a conversation or call occurred.
Electronic payment is not available yet. The pricing and checkout screens are informational: attempting to continue displays a coming-soon notice. IraqMoto does not charge a card, deduct wallet credit, activate a purchase or create automatic renewal from that screen. Access may currently be activated only as a documented manual test, trial, support grant or sponsored grant by an authorized administrator, with zero payment recorded. No grant automatically renews. Final provider, app-store, cancellation and refund rules will be published before IraqMoto accepts payment.
The packaged iOS and Android applications do not direct users to an external payment method for these digital products. If digital products are later sold inside an app, IraqMoto will use Apple In-App Purchase or Google Play Billing where required and will update the product disclosures, store declarations and policies before activation.
A Featured badge describes temporary visibility only. An IraqMoto+ badge describes an active account entitlement. A showroom tier describes commercial tools and limits. None is identity or business verification and none guarantees a seller, showroom, motorcycle or transaction. A verification badge may be granted only after IraqMoto actually checks the relevant business or identity under its verification process; verification is not sold.
IraqMoto does not display programmatic advertising or load third-party ad-network tracking. IraqMoto may operate clearly labelled sponsored campaigns in which a brand funds Featured visibility for eligible user listings. Sponsorship changes placement only, is not an endorsement or verification, does not permit the sponsor to edit a user's listing, and does not make the sponsor a party to a motorcycle transaction. Users' cookie and privacy choices are described in the Privacy and Cookie Policies.
Users retain ownership of their content. By submitting content, a user grants IraqMoto a non-exclusive, worldwide, royalty-free license for the period the content is hosted, plus any limited legal retention period, to host, store, reproduce, resize, format, display, distribute and moderate the content only as reasonably necessary to operate, promote and protect the Services.
The user represents that the user owns or has permission to use the content and that it does not violate law or another person's rights. The license ends when content is deleted, except for backup deletion periods, anonymized material and records lawfully retained for safety or legal purposes.
The IraqMoto name, logo, interface, software, original graphics and other IraqMoto materials are owned by or licensed to the operator and may not be copied, modified or used commercially without written permission. To report copyright or trademark infringement, email [email protected] with identification of the work, the allegedly infringing material, contact details and a good-faith explanation.
IraqMoto may warn a user, limit functionality, reject or remove content, suspend or permanently terminate an account when reasonably necessary to enforce these Terms, protect users, investigate fraud, address repeated violations or comply with law. Stolen-property fraud, serious threats, exploitation or repeated intentional abuse may result in immediate permanent termination and referral to authorities.
An affected user may appeal by emailing [email protected] with the account email, decision being appealed and relevant evidence. IraqMoto will review appeals reasonably but is not required to restore content or access where restriction remains justified.
Users may request deletion through Settings > Delete Account or https://iraqmoto.com/delete-account. Deletion is governed by the Privacy Policy and may require reasonable identity verification. Limited fraud, moderation, accounting, security or legal records may be retained where necessary.
IraqMoto may modify, suspend or discontinue features for maintenance, security, legal, technical or business reasons. We do not guarantee uninterrupted availability, permanent storage, a particular search position, a minimum number of buyers, or the completion of any transaction. Material changes to these Terms will be identified by an updated effective date and, where appropriate, notice or renewed acceptance.
The Services may link to third-party services governed by their own terms. Apple and Google are not parties to motorcycle transactions or to these Terms. Use of the iOS or Android app is also subject to applicable app-store terms. Where mandatory app-store or consumer rules apply, those rules control to the extent of a conflict.
To the maximum extent permitted by law, the Services are provided on an "as available" basis. IraqMoto does not warrant that user content is accurate, that a user is trustworthy, that a motorcycle is lawful or safe, or that a transaction will be completed. Nothing in these Terms excludes a warranty or obligation that cannot legally be excluded.
To the maximum extent permitted by law, IraqMoto and its operator will not be liable for indirect, incidental, special, consequential or punitive loss, loss of profit or opportunity, or loss arising from a motorcycle's condition, ownership, documents, payment, delivery, accident, user conduct or transaction between users.
Nothing limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that applicable law does not permit to be limited. Any additional monetary limitation should be reviewed by qualified Iraqi counsel before publication.
To the extent permitted by law, a user is responsible for claims, losses and reasonable costs caused by the user's unlawful content, fraud, infringement, transaction, violation of these Terms or misuse of another person's rights. This section does not reduce any non-waivable consumer right.
These Terms are governed by the laws of the Republic of Iraq. Subject to mandatory consumer-protection or jurisdiction rules, disputes fall within the jurisdiction of the competent courts of Baghdad. Users should first contact [email protected] so the parties can attempt an informal resolution.
If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions continue. Failure to enforce a provision is not a waiver. Users may not assign their rights or accounts without written permission. IraqMoto may assign these Terms to a lawful successor of the service with appropriate notice.
Arabic and Kurdish translations may be provided for convenience. The English version controls to the extent permitted by mandatory law if a translation conflicts with it.
